One time during their career self-employed persons who went bankrupt can appeal to a bankruptcy insurance.
The insurance covers:
- the protection of your rights to child benefit and health care during maximum 4 quarters without having
to pay any contributions that year - conditions
- a monthly allowance during twelve months max. - conditions
For whom
- self-employed persons who were declared bankrupt
- self-employed persons who are unable to settle their debts because of obvious incapacity and to whom
a collective settlement of debts applies
- business managers, administrators and working partners of a commercial company that was declared bankrupt
- not-tradesmen who cannot pay their debts
You are not eligible for bankruptcy insurance if you were convicted
by the criminal court as a result of the bankruptcy or when you have fraudulently organised your incapacity.
Requests
You can request your bankruptcy insurance from your social security fund.
Your request must be submitted before the end of the quarter following
the quarter in which the bankruptcy was declared.
In case of obvious incapacity the request must be submitted before the end of the quarter following the
quarter in which the activity was suspended.
Example: If you are declared bankrupt on June 19th 2003, your request must be submitted before
September 30th 2003.
